Terms of Service — GeoRank

These Terms of Service govern the use of the GeoRank platform (hereinafter: the "Service", the "Platform"), accessible at cms.georank.guru and georank.guru.

The Service Provider is Perfectinfo Sp. z o.o. with its registered office in Warsaw, ul. Ząbkowska 31, 03-736 Warsaw, Poland, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the capital city of Warsaw, XIII Commercial Division, under KRS number: 0000885968, Tax Identification Number (NIP): 5223198042, REGON: 388290075, share capital: PLN 20,000.00 (hereinafter: the "Service Provider", "we", "us").

The Service Provider operates within the European Union and is subject to Polish law and EU regulations, including Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

By using the Platform, you agree to these Terms of Service in their entirety.

GeoRank is a SaaS platform that connects Users with artificial intelligence (AI) models for the personalized creation of articles optimized for SEO and GEO (Generative Engine Optimization).

The Platform enables, in particular:

• automated discovery of trends and topics from various online sources (YouTube, Google News, LinkedIn, X);
• AI-powered generation of blog articles;
• AI-powered generation of graphics;
• personalization of content style and tone based on analysis of the User's website (Voice DNA);
• publishing generated content to the User's websites via WordPress integration.

The Service Provider exclusively delivers the technological tool (the Platform). AI-generated content is produced at the User's request and does not constitute editorial content of the Service Provider.

The User acknowledges and accepts that:

• content generated by artificial intelligence may contain factual errors, inaccuracies, or outdated information — a phenomenon commonly known as "AI hallucinations";
• the Service Provider bears no responsibility for the content, factual accuracy, completeness, or timeliness of AI-generated articles;
• the User bears full responsibility for the substantive and legal review of content before its publication;
• the Service Provider shall not be liable for any damages resulting from the publication of AI-generated content without prior review by the User;
• the Service Provider shall not be liable for any technical issues related to the publication of articles on the User's websites.

The User is obligated to review and approve all AI-generated content before publication.

Using the Platform requires creating an Account by registering with an email address or signing in via an identity provider (Google OAuth).

The User agrees to provide truthful and up-to-date information during registration.

The User is responsible for maintaining the confidentiality of their Account login credentials. All actions performed through the User's Account are attributed to that User.

The Service Provider reserves the right to suspend or delete an Account in the event of a violation of these Terms of Service.

The GeoRank Service is provided exclusively on a subscription basis (SaaS) in the following variants:

• monthly subscription — paid monthly in advance;
• annual subscription — paid in advance for a 12-month period (at a discounted rate compared to the monthly price).

Payments are processed via the payment operator Stripe, Inc. The Service Provider does not store Users' payment card data.

The subscription renews automatically for the next billing period unless the User cancels it before the end of the current period.

Service prices are listed on georank.guru and are subject to change. Users will be notified of pricing changes at least 30 days in advance. Price changes do not affect the current, paid billing period.

In accordance with Article 16(m) of Directive 2011/83/EU (Consumer Rights Directive), the right of withdrawal does not apply to contracts for the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and acknowledgment that they thereby lose their right of withdrawal.

Accordingly, once the subscription has been activated and access to the Platform has been granted (i.e., after the first payment has been made and the provision of the digital service has commenced), the User is not entitled to a refund for the paid billing period.

The User may cancel the subscription at any time. Cancellation means the subscription will not renew for the next period, but the User retains access to the Platform until the end of the current paid billing period.

The GeoRank Platform, its source code, interface, logo, and documentation are the intellectual property of the Service Provider and are protected by copyright law.

Content generated by AI at the User's request becomes the property of the User upon generation. The User may freely use, publish, and modify such content.

The User does not acquire any rights to the Platform's source code, AI algorithms, or models used in the content generation process.

The Service Provider makes every effort to ensure the Platform is available 24/7; however, 100% availability is not guaranteed.

The Service Provider reserves the right to perform technical maintenance for updates, servicing, or fault resolution. Users will be notified of planned downtime in advance.

The Service Provider shall not be liable for service interruptions caused by force majeure, failures of third-party providers (hosting, AI APIs, payment operators), or actions of the User.

The controller of Users' personal data is the Service Provider. Detailed rules regarding personal data processing are described in the Privacy Policy available at georank.guru/privacy-policy.

The Service Provider processes personal data in accordance with the GDPR and applicable Polish data protection legislation.

The User agrees to use the Platform in compliance with the law, these Terms, and good practices. In particular, the following are prohibited:

• using the Platform to generate content that is illegal, offensive, discriminatory, or infringes upon the rights of third parties;
• attempting to gain unauthorized access to the Service Provider's systems;
• sharing login credentials with third parties;
• using the Platform in a manner that could disrupt its operation or overload infrastructure beyond normal use;
• automated scraping or bulk downloading of data from the Platform.

The Service Provider shall be liable only for damages caused intentionally or through gross negligence.

The Service Provider's maximum liability towards the User is limited to the total fees paid by the User during the preceding 12 months.

The Service Provider shall not be liable for:

• content generated by artificial intelligence and published by the User;
• loss of data resulting from actions of the User or failures of third-party providers;
• indirect damages, lost profits, or reputational harm.

The Service Provider reserves the right to amend these Terms. Users will be notified of changes via email at least 14 days in advance.

Continued use of the Platform after the changes take effect constitutes acceptance of the amended Terms. A User who does not accept the changes may cancel their subscription before the effective date.

The User may terminate the Agreement at any time by canceling the subscription in the Account settings.

The Service Provider may terminate the Agreement with immediate effect in the event of a material breach of the Terms by the User, particularly in the situations described in § 11.

Upon termination, the User's data will be deleted in accordance with the Privacy Policy, except for data that the Service Provider is required to retain under applicable law.

These Terms shall be governed by and construed in accordance with the laws of Poland.

Any disputes arising from the use of the Platform shall be resolved by the court having jurisdiction over the Service Provider's registered office, subject to mandatory provisions regarding consumer jurisdiction.

Matters not regulated herein shall be governed by the provisions of the Polish Civil Code, the Consumer Rights Act, the Electronic Services Act, and other generally applicable provisions of Polish law.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
